Terms of Service

The following terms of service (“the Terms”), govern your use of Cost Master, provided by Goldberry Investments Ltd ("the Company"). By accessing or using Cost Master, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use Cost Master.

  1. Use of the Application
    • License: The Company grants you a non-exclusive, non-transferable, revocable license to use Cost Master for your personal or internal business purposes, subject to these Terms.
    • Restrictions: You shall not: (a) copy, modify, or distribute Cost Master; (b) reverse engineer, decompile, or disassemble Cost Master; (c) use Cost Master to create a competing product; (d) remove or modify any copyright or other proprietary notices; (e) use Cost Master for any unlawful purpose or in violation of any applicable laws or regulations.
  2. Privacy
    • Data Collection: Cost Master may collect certain personal and non-personal information from you. The Company will handle your personal information in accordance with its Privacy Policy, which is incorporated into these Terms by reference.
    • Data Usage: By using Cost Master, you grant the Company the right to collect, store, process, and use your data for the purpose of providing and improving Cost Master's functionality, as well as for statistical analysis and research purposes. The Company will anonymize and aggregate your data to ensure your privacy.
  3. Intellectual Property
    • Ownership: The Company retains all rights, title, and interest in and to Cost Master, including all intellectual property rights. These Terms do not grant you any rights to the Company's trademarks, logos, or other proprietary materials.
    • User Content: You retain ownership of any content you upload or transmit through Cost Master ("User Content"). By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, distribute, and display the User Content for the purpose of providing and promoting Cost Master.
  4. Disclaimer of Warranty
    • Use at Your Own Risk: Cost Master is provided "as is" and "as available" without any warranties of any kind, whether express or implied. The Company does not guarantee the accuracy, reliability, or availability of Cost Master.
    • No Professional Advice: Cost Master may provide cost information and analysis, but it should not be considered as professional advice. You should consult with a qualified professional for any specific construction cost estimates or construction cost data-related questions or concerns.
  5. Limitation of Liability
    • Indirect Damages: In no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of Cost Master.
    • Maximum Liability: The Company's total liability to you for any claims arising under these Terms, whether in contract, tort, or otherwise, shall be limited to the amount you paid, if any, to the Company for accessing and using Cost Master.
  6. Termination
    • Termination by the Company: The Company may, at its sole discretion, terminate or suspend your access to Cost Master at any time, without prior notice or liability, for any reason, including if you violate these Terms.
    • Termination by You: You may stop using Cost Master at any time.
  7. General
    • Modification: The Company reserves the right to modify or update these Terms at any time, and such changes will be effective upon posting the updated Terms on Cost Master or The Company's website. Your continued use of Cost Master after any such changes constitutes your acceptance of the revised Terms.
